David Michaeli is a trial lawyer focused on resolving high-stakes disputes for global businesses.  David has tried numerous cases before state and federal courts and arbitration tribunals and regularly advises leading businesses around the world on their most complex matters. David emphasizes commercial knowledge, strategic thinking and creativity to help clients achieve their business objectives.

David's practice, which has earned him recognition by a prominent trade publication as a Rising Star in the areas of business and appellate litigation, includes transactional advice and dispute resolution. David represents clients in many industries, with a particular focus on private equity and hedge funds, financial services, manufacturing, and aviation. He has extensive experience litigating and advising on cross-border claims, including judgment and arbitration award enforcement and 28 U.S.C. § 1782 actions, which David has litigated successfully in a dozen U.S. jurisdictions.  David has recovered billions in cash and non-cash compensation on behalf of his clients, and he has also successfully defended billions of dollars in claims.

David has published dozens of articles on legal and industry issues, including on M&A law, the aviation industry, and the Foreign Sovereign Immunities Act.  He has advised clients on hundreds of M&A, joint venture, and other transactions, including on dispute avoidance, risk allocation, and risk mitigation issues.

David also maintains a robust pro bono practice. David has represented death-sentenced defendants in innocence proceedings, domestic violence victims and asylum applicants, and also regularly advises charitable organizations on a host of legal issues. David formerly served as secretary of the New York City Bar Association's Committee on State Courts of Superior Jurisdiction, and as a member of that committee's Legislative Subcommittee.

Representative experience

Trial counsel for a telecommunications company, winning an arbitration award valued at tens of millions of dollars against a French aerospace and defense manufacturer for breach of contract

Won a highly favorable settlement for a private equity M&A buyer in claims for fraud and breach of contract in the Delaware Court of Chancery against the sellers of a health care business

Won a highly favorable settlement for a private equity M&A buyer in claims for fraud and breach of contract in the Delaware Court of Chancery against the sellers of a technology business

Represented the buyers of more than 835 Boeing 737 MAX aircraft, valued at more than $80 billion at list prices, in multi-billion dollar claims arising from the grounding of the 737 MAX

Won dismissal of a US$100m action brought against a German financial services client in the U.S. District Court for the District of Nevada on forum non conveniens grounds

Represented an energy company in multi-million dollar claims against contractors in Pennslyvania court relating to explosions during hydraulic fracturing operations, leading to substantial settlements
