Successful trial victory for B. Braun Manufacturing Inc., a leading medical technology company, obtaining a complete defense verdict in the first trial in Philadelphia involving allegations that the use of ethylene oxide caused cancer.
Defended Danco Laboratories in a unanimous U.S. Supreme Court decision allowing Mifeprex® (mifepristone), a drug for the termination of early pregnancy, to remain on the market, in one of the most closely watched cases in the United States.
Represented Viatris (formerly Mylan) in U.S. District Court litigation in Minnesota, securing denial of class certification in a direct purchaser pharmaceutical action based on failures of numerosity, adequacy, and predominance.
Represented Bristol Myers Squibb in a nine year dispute culminating in a Hawaii Supreme Court decision overturning a US$1bn judgment relating to the marketing of the drug Plavix.
Acting for ENRC in connection with a range of unprecedented disputes arising out of an internal investigation and “self-reporting” process with the Serious Fraud Office (SFO).
Acted for a global chemical company in several contractual disputes concerning long-term supply relationships in countries such as the U.S., Germany, and China.
Acted for Blue Cross in long running litigation against the State of California, resulting in the insurer avoiding US$4.3bn in retroactive tax liability.
