In the article, the authors discuss recent recommendations by the Joint Committee of the European Supervisory Authorities regarding the EU Securitisation Regulation, addressing due diligence, transparency, risk retention and definitions concerning public and private securitisation.

The recommendations include clarifying the obligations of EU and non-EU parties, revising due diligence requirements for investors, reinterpreting the risk retention “sole purpose” test and streamlining reporting and disclosure templates. The article notes that while some recommendations have immediate effect, others would require legislative amendments.
