Two articles by Cadwalader lawyers are featured in the June 2024 edition of Pratt’s Journal of Bankruptcy Law.

“The Court of Appeal Judgment in the Adler Restructuring Plan: Pari Passu Is Back!” by Gregory Petrick, Bevis Metcalfe, Simon Walsh and William Sugden. In this article, the authors examine a decision by the Court of Appeal of England and Wales to overturn the Adler Group restructuring plan.

“‘Know Your Customer,’ or Agent, or Financial Institution, to Qualify for the Bankruptcy Code Safe Harbors,” by Ingrid Bagby, Kathryn Borgeson, Michele Maman, Eric Waxman and Marc Veilleux. In this article, the authors review a recent decision by the U.S. Court of Appeals for the Second Circuit and explain that parties must structure their transactions with precision and close adherence to statutory and case law requirements to gain protection of the safe harbors afforded under the Bankruptcy Code.
