The EU Foreign Subsidy Regulation, in between burden, threat, and opportunity for global undertakings – How to navigate through it?

As of 12 July 2023, the EU’s Foreign Subsidies Regulation (FSR) will apply.

It gives far-reaching powers to the European Commission (EC) to tackle distortive effects of direct and indirect financial support granted by non-EU public authorities.

Since this new act takes the form of a regulation, companies may also be able to start action before national courts to seek damages or other relieves.

The scope is so broad that it will have serious implications for many company activities.

Hogan Lovells and The Brattle Group will host a series of webinars over the next few weeks to address the main challenges companies will face, offering practical tips to help addressing the issues raised by this regulation. We will also explore opportunities to challenge competitors through the FSR.

In our first webinar we will cover key aspects including what constitutes a subsidy, quantifying the advantage, what is market distortion, the tools available to the EC, and addressing effective compliance.
