Complex issues arise when restructuring a business that includes the sponsoring employer of a defined benefit (DB) pension scheme. The Pensions Regulator is taking a tougher approach to action that may impact a DB scheme, and will soon be strengthened by new investigatory powers and backed up by wide-ranging criminal and civil penalties.
